This document (together with the documents referred to on it) sets out the terms and conditions on which we provide the services or information (Services) listed on our website www.mindbodyandtravel.com (our site). Please read these terms and conditions carefully before making use of any Services from our site. By making use of the Services available on our site, we are entitled to assume you have read these terms and conditions and you agree to be bound by them.

1. Information About Us

www.mindbodyandtravel.com is a travel directory site operated by The Lifestyle and Wellness Group Ltd registered in England and Wales under company number 13218684, 71-75 Shelton Street, London WC2H 9JQ. In these terms and conditions, “you” and “your” means all persons named on your booking (including anyone who is added or substituted at a later date) or any of them, as the context requires. “We”, “us” and “our” means The Lifestyle and Wellness Group Ltd. 2. Your Status

2.1 You must be at least 18 years old at the time the booking is made.

2.2 You agree to abide by the terms or conditions of purchase imposed by the supplier who has responsibility for your booking, including, but not limited to, payment of all amounts when due and compliance with all rules and restrictions regarding availability and use of fares, products or services. Special rules and restrictions may apply to a fare, product or service selected by you. You understand that any violation of any such supplier’s conditions of purchase may result in cancellation of your reservation(s) or purchase, in your being denied access to any flights, hotels or automobiles, in your forfeiting any monies paid for such reservation(s) or purchase.

2.3 You shall be completely responsible for all charges, fees, duties, taxes and assessments arising out of the use of this site including without limitation any fares or the costs of products or services provided by suppliers with whom you contract via this website.

3. Bookings and Pricing

3.1 All deposit payments are non-refundable and non-transferable, your deposit secures the quoted price at the time of booking.

3.2 Your booking is only confirmed once you have received confirmation from Mind, Body and Travel via email.

3.3 Full payment for your booking must be received no less than 10 weeks prior to departure. If full payment is not received by your payment due date, we reserve the right to cancel your booking at the loss of deposit.

3.4 All prices listed are per person and are all in pounds sterling (unless otherwise stated). We reserve the right to change or amend prices at any time before you have booked.

3.5 Once your booking has been made and we have received payment from yourself the prices are guaranteed and won’t change unless an amendment is made. This cost may be higher or lower than the original booking made due to a number of factors including room availability, date popularity and the room types available.

3.6 Please be aware that we also reserve the right to increase the total cost of your holiday prior to your departure if currency fluctuations between GBP and your respective destination’s currency results in the costs to us of providing your holiday rise by more than 2%.

3.7 We reserve the right to make changes to, and correct details after bookings have been confirmed. If amendments are made, you may receive several booking confirmations in between your booking date and your arrival date. Please ensure that these confirmations are checked thoroughly to note any changes that have been made. The latest confirmation should reflect the final details as held by both the venue and the customer.

3.8 We are unable to accept liability for any errors and omissions that are not highlighted to us prior to arrival, and the customer remains responsible for any additional costs or changes that occur as a result.

4. Amendments and Cancellations

4.1 The Company will make every effort to assist you if you wish to alter your arrangements. Requests for an amendment must be emailed in by the lead booker unless authorisation for another guest to make amendments has previously been received in writing.

4.2 Any changes to an existing booking that are made after receipt of booking confirmation will be charged at £50 per change and are subject to the hotel’s individual amendment and cancellation policies. If the Company is not successful in making the change then there will be no charge.

4.3 Any extra charges incurred from the supplier will be charged in addition to this. Single or triple room types may carry additional fees if required to accommodate the new size of the party booking.

4.4 Amendments can be made if the new dates are within 365 days of the original departure date, however, this may vary slightly depending on the hotel’s in house reservation system.

4.5 In the unlikely event that we need to significantly amend (e.g. change flight timings by 6 hours or more, change in accommodation etc.) or cancel your holiday, you can choose from one of the following options:

  • Book another available holiday from us; paying or receiving the difference in price.
  • Cancel your holiday with a refund (minus any supplier costs of ours and any previous amendment fees).
  • Accept any amendments made to your holiday.

We will inform you of any amendments to your holiday before taking action.

4.6 All amendments must be made through Mind, Body and Travel as updated confirmation details will be administered accordingly. We will not accept any responsibility for any issues arising at the hotel if we have not previously been advised of the booking change requirements and provided verification via a change confirmation.

4.7 Some venues do not permit cancellations at any time, and therefore full payment must be made at the time of booking. You will always be informed of this before committing to a booking.

4.8 If you fail to pay the balance of the holiday price at least ten weeks (seventy days) before departure, the company will treat your booking as cancelled and apply the cancellation charge as set out in paragraph 4.9 below. If the company is obliged to cancel your holiday in any other circumstances before departure, the company will use its best endeavours to offer alternative arrangements at no extra cost to you or offer a substitute package of lower quality and you may recover from the company the difference in cost.

5. Payment

We accept debit or credit cards as a form of payment for your holiday. We can also accept payment by bank transfer. Unfortunately, we do not accept AMEX payments.

6. Travel Destinations Risks

6.1 Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. We urge passengers to review any travel prohibitions, warnings, announcements and advisories issued by The Foreign and Commonwealth Office Travel Advice Unit prior to booking travel to national and international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found on the FCO’s website currently located at https://www.gov.uk/browse/abroad. It is your responsibility to ensure you are aware of all recommended vaccinations and health precautions in good time before departure. Details are available from your GP surgery and from the National Travel Health Network and Centre http://travelhealthpro.org.uk/. Information on health abroad is also available on http://www.nhs.uk/Livewell/TravelHealth/Pages/Travelhealthhome.aspx. Holidays in the EU/EEA you should obtain an EHIC (European Health Insurance Card) prior to departure from http://www.nhs.uk/NHSEngland/Healthcareabroad/EHIC/Pages/about-the-ehic.aspx. An EHIC is not a substitute for travel insurance. Vaccination and other health requirements/recommendations are subject to change at any time for any destination. Please, therefore, check with a doctor or clinic not less than six weeks prior to departure to ensure that you have met the necessary requirements and have the applicable information.

6.2 By offering for sale travel to particular international destinations, we do not represent or warrant that travel to such points is advisable or without risk, and is not liable for damages or losses that may result from travel to such destinations.
Please note: we are not open 24 hours a day and do not have an emergency out-of-hours contact. Should an emergency arise outside of the opening hours listed on our website, we cannot, therefore, be held liable for any costs as a result from missed flights, transfers or accommodation. Should an urgent situation arise, please still contact us and we will respond as quickly as possible

7. Passport, Visas, Immigration and Health Requirements

7.1 It is the responsibility of each guest to fulfil passport, visa and other immigration requirements for the countries you intend to visit, and we will not accept responsibility if you are unable to travel due to not complying with any such requirement. You should ensure that you have a valid passport and we would recommend that your passport is valid for a minimum of 6 months after return.

7.2 Please keep in mind that vaccinations may be required for some of the countries you intend to visit

8. Travel Insurance

8.1 All guests travelling on each booking must have travel insurance as we cannot be held responsible for any liability, losses, or expenses you may incur. We strongly advise comprehensive travel insurance that cover our policies for amendments or cancellation charges is purchased at the time of booking.

9. Important Additional Information

9.1 If you are booking your own flights or any other means of transportation, please do not book these until your booking has been confirmed by us and after receiving a booking reference number and email confirmation – this confirmation means we have availability for all our suppliers necessary to fulfil all elements that make up your booking.

9.2 All bookings will be subject to the venue’s own terms & conditions whilst in resort.

9.3 Throughout your booking visit with Mind, Body and Travel you accept full liability for any damage or loss caused by you or any member of your group. If it is believed that any member of your party causes offence, distress, danger, damage or annoyance to either other guests, staff or property, we may terminate your booking and holiday with immediate effect. Thereafter we will not take responsibility for any party member; our contract with you will be terminated and the full cost of the holiday forfeited without any compensation or refund or expenses you may incur.

9.4 When you buy an ATOL protected flight inclusive holiday from us you will receive an ATOL Certificate. This lists what is financially protected, where you can get information on what this means for you and who to contact if things go wrong.

9.5 All programme inclusions within your holiday, are subject to amendments by the respective partner hotels who offer them. We will always do our best to represent the most up to date information, but we cannot be held responsible if the partner has edited, removed or changed the inclusions and failed to notify us.

9.6 Once booked, we may need to pass on your contact email address and telephone number to the hotel or organisers to enable direct contact regarding certain aspects of your booking.

10. Problems/Complaints

10.1 If you have a complaint during your trip, please bring it to the attention of the supplier as soon as possible so that they can address the issue immediately and provide the best chance of resolving your issue; failure to do so may hinder any claim you wish you make on return. If you are still unable to resolve your issue, please contact us so that we can be best equipped to help you whilst you are away. If you wish to complain on return, you must do so within 28 days from the day of arrival back home.

11. Information and Suitability

11.1 The content of our pages was compiled with utmost diligence. Occasionally, errors may occur in that the information, products, and services published on this website may include inaccuracies or typographical errors. In particular, Plus Lifestyle and Wellness Group Ltd, do not guarantee the accuracy of, and disclaim liability for inaccuracies relating to the information and description of accommodation, air, cruise, car, attractions and all other travel and holiday products displayed on this website (including, without limitation, photographs, list of hotel amenities, general product descriptions, etc.), much of which information is provided by the respective suppliers. Any accommodation rating displayed on this website is intended as only general guidelines, and Plus Lifestyle and Wellness Group Ltd does not guarantee the accuracy of the rating. Changes are periodically added to the information herein. Plus Lifestyle and Wellness Group Ltd its affiliates and/or their respective suppliers may make improvements and/or changes on this website at any time. We update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely.

12. Our Right To Vary These Terms And Conditions

12.1 We have the right to revise and amend these terms and conditions from time to time.

12.2 You will be subject to the policies and terms and conditions in force at the time that you make use of the Services provided by us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (which if appropriate will be deemed to apply retrospectively).

13.1 These terms (together with the documents referred to on it including without limitation the data protection and terms and conditions of supply) tells you the terms of use on which you may make use of our website www.mindbodyandtravel.com (our site), whether as a guest or a registered user. Please read these terms of use carefully before you start to use the site. By using our site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please refrain from using our site, and leave it immediately.

14. Modification of these terms & conditions

14.1 We reserve the right to change the terms, conditions and notices under which this website is offered without prior notice.

15. Force Majeure/Unavoidable and Extraordinary Circumstances

15.1 Mind, Body and Travel will not be liable for additional expenses incurred through travel delay, Acts of God, force majeure or events beyond our control. Force majeure/ Unavoidable and Extraordinary Circumstances is unusual and unforeseeable circumstances beyond our control such as war or threat of war, riots, civil unrest, terrorist activity, industrial disputes, natural or nuclear disaster, significant risks to human health such as the outbreak of a serious disease at the travel destination, fire or adverse weather conditions. The above will also apply to the liability of our spa venue partners.

15.2 In these Terms and Conditions, where we refer to Unavoidable and Extraordinary Circumstances, it means a situation beyond the control of the party who invokes such a situation and the consequences of which could not have been avoided even if all reasonable measures had been taken.

15.3 Except where we say differently elsewhere in these conditions, we cannot pay any compensation, reimburse expenses, or cover losses for any amount or otherwise accept responsibility if, as a result of Unavoidable and Extraordinary Circumstances, we have to cancel your booking prior to departure, any refund can be issued by way of a credit refund voucher.

15.4 Except where we say differently elsewhere in these conditions, we cannot pay any compensation, reimburse expenses, or cover losses for any amount or otherwise accept responsibility if, as a result of Unavoidable and Extraordinary Circumstances, we change your booking after departure, or we, or our suppliers, cannot supply your booking, as we, or they, had agreed, or you suffer any loss or damage of any description.
